PIAB Recommendation??

    Hi Guys,

    I have had a piab recommendation offer made to me.

    If i accept - do the other guys pay out immediately or do they / can they contest it?

    and what legal fees would i expect? 1 yr since accident.

    offer 20K

    Depends on the injury.
    How does it compare with the range on the injuries board website?

    Had one myself. Solicitor took roughly 8%

    They can decide to reject it or you can. If you reject it and are awarded less in court then you may find yourself unable to claim legal costs.

    If you chose to go to court and you don't beat the PIAB offer/lodgement then you pay all the court expenses for both sides.

    I dont actually know for sure

    but my opinion is that there is an element of risk in going to court

    My own experience is that when I had an offer that was close to what was suggested for similar injuries, I elected to accept that offer on the basis that the risk of dealing with the the PIAB / court, plus the associated costs (including my time) were not worth it, i.e. there was limited upside, and potential downside. This was in a case where fault was not disputed. Your own experience may vary, but these are the factors you should consider.
