Personal Loan Recovery

    Hi Folks,

    First off I am not looking for legal advice, I simply wish to know what options or avenues exist under Irish law for the recovery of a funds loaned to an individual as a personal loan.

    Is this something that can be dealt with by the small claims court?

    I will be engaging a solicitor but before having a consultation and being out of pocket a few hundred Euro I would at least like to know that there is some remedy rather than sitting in a solicitors office while he spins out a yarn to get his fees when there is nothing that can be done.

    Any an all input welcome and again I am not looking for advice I am looking for broad information on what avenues exist in Irish legislation that would allow me to recover the funds.

    Your issue won't be getting a judgement it will be enforcing that judgement. Chances are if this person approached you for a loan then they couldn't get one elsewhere? What assets do they have that the sheriff can seize?

    Have a google and a look over the forums. They are generally pretty useless at enforcing against private parties.

    Most solicitors will give you an initial consult for free. Cover this area off because it will likely dictate whether or not it's worth going ahead.

    Factors to be considered.

    Did the parties involved have a signed agreement between them.

    Did the agreement state how much was to be paid and when?

    Small Claims Court does not deal with debt claims. It is District Court up to15k.
