    Hi was in car crash 10 years ago , now (today ) solicitors have sent me a summons for 100.000€, can they claim so many years on? I here it's 7 years max they have to follow me ...
    I hope I'm right or I'm out of here . Any help much appreciated.

    Statute of limitations is 2 years for personal injury.

    Are you able to provide any more information ?

    was told claim can remain open up to 6 years-dunno how each company handles it thou.

    Was there a child involved that may have just turned 18?. That MIGHT be a reason for the 10 year gap.

    6 years is correct for a tort othen than personal injury. It is also is 6 years for contracts and going after accounts.

    It can be 12 years in cases of land.

    Would need to provide more info (which OP probably can not) before we could say. With a claim for €100,000 after a car accident I would image it's personal injury related in which case 10 years is a bit of a stretch.

    It's obviously serious however OP. Especially since proceedings have been started.

    Were you insured at the time ?

    Whatever you do, you need to take the letter to a solicitor.

    had no insurance, went to coirt just got a small fine, heard nothing till now

    The slap on the wrist and fine in court was for the criminal charges of no insurance.

    It seems like you are being sued through the civil courts for the injuries of the injured party.

    You really need to consult a solicitor.

    Ive never heard of someone claiming so long after an Incident.

    Ive heard of cases been settled after years but not starting this late.

    Best contact a solicitor to get more details

    Ah the Insurance company got paid too my upping everyone's premiums ; )

    Best get a solictor i guess

    so it looks like the bureau have only recently settled with the other party (in the last couple of years) and now since that claim is settled and they know the extent of the liability they are going to you to recoup their payout.

    I have no idea about the legality of time frames and this is where you'd be best advised to engage a solicitor to advise you.

    On a side note, as a motorist and someone who pays a levy each year to cover uninsured drivers it does hearten me to hear that they actually do pursue those who cost us all money.

    That would be if they did pass the recouped money back to you which they dont.

    i dont think you quite understand how this works. Driver has an accident. Driver has no insurance. Injured party have no insurance company to sue so they sue the MIBI. The MIBI then sue the driver to recoup the money they have payed out. If the driver has no money then the MIBI has to eat all the costs. The MIBI are funded by the insurance companies. The more they have to pay out the more the insurance companies have to pay to keep the MIBI going. the more the insurance companies have to pay the higher insurance premiums are. Any money recouped goes to the MIBI which reduces the amounts the insurance companies have to pay which reduces premiums.

    If the OP has any assets, they could probably go after them, including his house, or current car.

    If the MIBI or anybody else is bringing an action to recover €100,000 from you, you need to see a solicitor.
