Holiday pay when left job

    Hi there just need a bit of help. Could anybody tell me am I entitled to any holiday pay on top of my last week wages as I have recently left my job for a full time contract. I was there for 3 months and it was with a job agency.

    Yes. You should be paid anything outstanding to you on your last payday, back week and holiday pay or time owed etc..

    If you were temping through the agency you may not be entitled to holiday pay as far as I know.

    I am paid by the agency so I am just wondering why should I have to contact them, should they not just pay me what im owed instead of having to chase them?

    It wasnt a temporary position either.

    Hi OP, this document explains your entitlements in respect of paid leave:

    As you were paid by the employment agency then they are considered as your employer for the purposes of the Organisation of Working Time Act, and are responsible for providing your holiday entitlements.

    Ideally you would not have to do any pursuing of the agency for outstanding monies but then we don't live in an ideal world. Contact them and ask what the situation is, if they continue to withhold monies owed then the complaints procedure to be followed is explained in the linked document. I'd also recommend a visit to your local Citizens a information centre.

    That's what I used to think, before I did some agency temping and found I was entitled to paid A/L on a pro-rata basis.

    Have they issued you a P45? If not, then they may not have processed your termination - and it's likely that doing this includes paying out your holidays.

    If you did get a P45, then check your last payslip carefully: if you were on emergency tax, or low paid and the holiday pay pushed you up into being liable for USC on your whole pay, then it's possible that you were actually paid out and didn't notice.

    After checking those things, you will have a better idea of what specifically to approach them about: it may just be that you need to ask for your P45 and final pay.

    Thanks for all the replies. I will give the office a ring to make sure they put the holiday pay in my wage in friday. Ive been talking to a lad that no longer work there and they said they never got any holiday pay when they left even tho they should be entitled to it.

    hi, I work for a company for 8 year and now I resign. I didn’t manage to take all my holiday for the past 8 year., but now they told me I cant claim the holiday payment from the past. is it true?
