Are GArdai obliged to give Insurance details to injured party

    SITUATION
    Car hits van. Van driver is concussed and injured. Gardai arrive and take everyones details. Car drives away. Van driver gets lift home as Van wrecked.
    Van driver, when recovered somewhat, rings Gardai for car drivers insurance details etc. so he can inform his insurance company.
    Gardai refuse to give him other cars details even after repeated requests.

    This doesn't sound right to me. He can't pursue claim, even if he was proven to be at fault.
    Any comments appreciated.

    They wouldn't give it to the driver of the van but would give it to the van drivers insurance company. Data protection. There are procedures between the Gardai and insurance companies for such things. Just ring your insurance company and tell them that Garda Joe Bloggs of x station has the info.

    A concussed and injured man would surely be going to hospital would they not?In any case, it's likely the only Garda that has the info is the investigating one. They won't give it out until they have seen an insurance certificate which the other driver has 10 days to produce. Driver should notify his insurance company who will write to Garda.

    Unless there has been a recent change, if a party affected or his/her solicitor writes to the relevant Supt a reply issues confirming drivers' identities and insurance details

    Thanks for all the replies.
    The injured party told me he was injured and dazed and not in a state to even think of what to do. Maybe he should have gone to Hospital, I don't know. He is very upset about this but following the information that has so kindly been given here I will suggest that he ask his insurance company to contact the investigating Garda how to proceed.
    It never occurred to me that the car driver may have been asked to produce their insurance details within 10 days.
