Car impounded, got summons

    Hi, quick query.

    My car was parked on the street, and gardas saw it had no tax.

    They impounded the car. Before I could get the car back, I had to pay the back tax "arrears" plus the pound fee and produce my licence at the station.

    I done all that 3 months ago, and my tax on my car is now fully up to date.

    Now I've been summoned to court.

    Few queries, I never got an fines or penalties points before the summons, is this not the step before court?

    What is the minimum and max I can be fined/ penalty points?

    What other options in terms of punishment can I receive?

    Seems v strange to not even an notification in relation to the matter, but a court summons.

    Any help appreciated.

    You could have collected it on a trailer and not paid the back tax ;)

    I'm sure if you check on the impound notification you received all the details of offences were printed. I don't know what other info you are looking for? You may have been under the impression it was an on-the-spot fine only when, in fact, it was always going to mean a Court appearance?

    I never got an "on the spot " fine though, or notice of penalty points. And I didn't receive an impound notification.

    I was told where my car was been taken and was told where to go and how to get it out. This being, go to Garda station show prove of ownership of the vehicle, show id, show proof I paid the arrears of tax and have tax up to date, and then pay €125 when I went to the pound.

    There was never a mention of court, just that my car couldn't be drove without tax so it was taken to the pound.

    I got no fines or warnings just straight to court.

    I understand it's serious, but no advanced warning?

    Did you complete it within 56 days of the original offence? The penalty notice was the one that made you aware your car was impounded. Even if you become tax compliant, you have failed to comply with the terms of the FCPN for non display. There doesn't appear to be a non display offence for tax which can lead to a court appearance.

    Did you pay the FCPN or just the tax and arrears?

    My car was parked. My daughter was in it and I was getting in when the gardas stopped me.

    They made us get out and took the keys. I didn't get anything in writing that they were impounding the car, just directions to the pound.

    The pound gave me nothing either, just a receipt for the pound fee.

    So I didn't get an fcpn, so I just paid the tax and arrears.

    But you have to sign a form when they take your car basically declaring you have removed items you wanted from it. I find it strange they took it without giving you any paper work.

    So i just got a very organised Garda when my car was lifted :rolleyes:.......he gave me paper work that i signed to say i had taken what i wanted from the car im of the presumption its so people cant say they had stuff taken from the car while it was in the impound.

    Both myself and the OH had our cars impounded after an accident. No form signed until we retook posession of the cars.

    Also, if a car is being forcefully taken for no tax, the person wouldnt sign or it would create issues at least in most cases.

    My car was out 2months of tax it was taken at a checkpoint he gave me sheet to sign to say there was nothing left in the car that i wanted before they took it away. I pretty sure if you didnt sign it then you cannot complain if you think something was taken whilst it was in the pound. If i can find the sheet ill screen shot it and stick it up.
