Seller wants a photo.

I ordered a green lava lamp off ebay. When it arrived it was yellow, not green and a really cheap rubbish one with dirty cloudy lava. The outside was dirty and it wasn't in it's original packaging, it looked like it was a return from a previous customer. I told the seller I want them to have it collected and give me a refund. They said they will, but only if I email them a photo of the defective item first "for their warehouse manager's reference."

I can't do this as my camera phone was stolen 2 weeks ago, and I simply can't be bothered going to the hassle of getting someone else to do it for me. Can they refuse to refund me without a photo?

No, but it will speed up the return process.

Possibly they will allow you keep that one and send you out a replacement.

Just mail them back you've no camera to shoot a photo. And mention if they insist to have a photo maybe they send you a camera? :D

How will it speed up the return process? And I don't want a replacement I want a refund.

eh, ok I see I need to explain this a little more.

The item may not be of such a value that it is worth organising a courier to collect it.

Therefore the company may look at the option of providing you a replacement (or refund) and also let you keep the one you have.

Alternatively, they could be looking for photo so that they can do the refund once the item has been collected from you and not having to wait until it arrives back.

And also, they could be checking that you are telling them the truth - imagine, there are some people out there that tell lies about the state of goods because they suddenly change their mind!

Is that enough reasons for you?

Well, although I couldn't take a photo they had it collected anyway. However five days later and they are ignoring my messages and haven't refunded me. When it was collected I wasn't given a receipt or tracking number or anything, but I have their previous messages saying the date they were having it collected. Is that enough to claim my money back through ebay if necessary?
