LAND REGISTRY or REGISTRY OF DEEDS ?

    Not a request for legal advice just a steer in the right direction please as I am trying to assist an elderly relative to sort out some paperwork.

    My uncle inherited a house in Dublin with a leasehold title. He bought out the ground rent. He got a vesting certificate and a bewildering form to register the property with the Land Registry.

    We are wondering if he cannot just register the vesting certificate in the Registry of Deeds or must it be done with the Land Registry ? The forms that he was sent don't seem to give an option to record the certificate with the Registry of Deeds.

    There's no more lodging of deeds in the Registry of Deeds, following the introduction of compulsory registration everything must be registered in the Land Registry. If you go into the PRA I'm sure you'll find them very helpful, they'll be used to dealing with plenty of first registrations at this stage.

    BTW do we have to get a map to lodge with the Vesting Certificate ?

    What do we need to get in terms of a map ?
    Is it a survey of the ground that makes up the property or just something more basic ?
    Who would do that ?

    Not exactly correct, compulsory registration in Land Registry is for properties sold. Voluntary stuff is not compulsory yet.

    So, can OP's uncle register the Vesting Certificate at the Registry of Deeds ?

    I am just curious as we have something similar on hand at the moment and will probably have to sort out the same question next year.

    According to Lyall a vesting certificate under the Landlord and Tenant (Ground Rents) (No 2) Act 1978 is deemed to be a 'conveyance for sale' for the purposes of the SI governing compulsory registration. Basically as far as I'm aware the testamentary conveyance wouldn't have to be registered, but the conversion from leasehold to freehold (i.e. the vesting certificate) would.
