The person reversing out as they are moving onto the major road.

Or you know, a bit of common sense and courtesy, whoever is there first, it will only take 10 seconds or so.

Thanks for response but as I stated its a cul de sac not a major road. And I know it only takes 10 seconds but I just want to know who has the Legal right of way. As one car is forced to stop all the time where the other car assumes right of way, the people involved are not on friendly terms.

Even the smallest of Cul de Sac's is the Major road, when compared to a private Driveway.

Taken from the Rules of the Road
"You must not reverse from a minor road onto a major road as it is unsafe
to do so". Is this not contradicting what yer saying

No - it says exactly the same thing. The minor road in this case is the driveway - the major is the cul de sac. Think of it in terms of roads of lesser/greater importance. It doesn't actually mean a major road like the N17 or M50.

All things aside - You never have right of way when reversing.
