Executor of will

    Can an executor of a will just resign, does it go to a judge? My husbands Mum left one of brothers as executor and because another brother contesting, it has dragged on for four years, can executor resign and if he does what consequences will it have?

    Has the designated executor got around to taking out a grant of probate yet, or has even that been held up by the challenge?

    Yes grant of probate came through in Jan 2011, and the brother who contested did so within his 6 months, issuing a civil bill against the executor and it has just been held up between solicitors since.
