    Hi

    Just wondering what are the penalties, if any for a passenger driving with a learner driver if the passenger doesn't hold a driving licence?

    I'm fully aware that learners need to be accompanied at all times and I'm just wondering what trouble a passenger would be in for driving with a learner?

    I'm not the driver or passenger, I am asking this on behalf of someone else.

    Any information is greatly appreciated.

    I don't believe the passenger is committing any offence, it's solely up to the learner driver to ensure he/she is accompanied by a suitably qualified driver.

    The passenger isn't committing an offence. The driver is by driving unaccompanied.

    But the passenger would be a fool for getting into the car with an unsupervised learner.

    Unless the passenger pretended to have a full licence I don;t see how they could be held to account. It's a responsibility on the driver.

    I know off no offence punishable by law a unlicenced passenger commits by travelling with an unaccompanied learner driver.

    You could possibly argue that the passenger is guilty of some kind of aiding and abetting if the purpose of having them in the car is to give the impression that the learner driver is being accompanied as he or she should be. But I have never heard of such a charge actually being brought, and it's hard to imagine real-world circumstances where it would be likely to be brought.
