overpaid by employer ?

    I have been working a few months with my employer but I noticed I was being paid alot more than I thought I had agreed.
    I proceeded to contact payroll who assured me that I was not being overpaid and gave me a breakdown and closed the case.
    The monthly breakdown equates to the gross figure in my contract being paid as the net figure !

    I will give the money back as I am honest, but do I have any claim to this money legally when I have written evidence from payroll that I have not been overpaid ?

    Also typically when would this get spotted.

    I'd say you should keep the money to one side, as they may ask for it back. Also keep a copy of the e-mails (assuming there are any) you sent to the payroll department, you never know, you might need to prove you're acting in good faith.
