    and it's a family car used by more than one person... how do the Gardaí know who was driving it?

    They sent a pic of the number plate, would they also have a picture of the driver?

    Its the registered owner that gets the points. Unless YOU can prove someone else was driving!

    Surely nominating other driver who accepts blame is the easiest way to prove it wasn't you.

    But if you can prove you were somewhere else, and couldn't drive the car at the time of offence, then this will be good enough as well.

    How do you propose doing that without nominating the driver at the time.
    You don't have to nominate the driver if you genuinely don't know who the actual driver was, but you do have to inform the Gardaí of anyone who was likely to have had use of the car at the time. It's then up to the Gardaí to investigate.

    When they get the letter they agree and except the points or deny that they were driving and go to court.

    The were happy to let me take the points after I was caught on my brothers bike, so happy they never even bothered to check if I was legal on it!

    The driver of the car makes no difference,

    It's the car (reg) that's get done.

    I was caught for speeding in my mothers car summer 2009, She rang me like it was the end of the world after she got a letter in the post.

    I sorted it all out after admitting it was me driving the car and got everything transfered to my licence ( yes i love my mother that much)

    AFAIK yeah if you want to agree someone else to get the points you can do it, but if you ever do get found out that you deliberately put another drivers name down that you knew wasn't the driver then the crime becomes perverting the course of justice or perjury which carries a far stiffer penalty than speeding

    It doesn't get investigated. If you say "X was the driver", they re-issue the ticket to X and if he pays up, then he gets the points and that's that.

    I was not aware of that.


    Would the same apply if, for example, Penalty Points are re-issued to X, and X has a means of getting the points cancelled?

    They don't reissue any fixed penalty notice. It's up to the notified person to pay the fixed penalty or get it paid by the person who committed the offence.     that's not correct. There's a section on the ticket to complete if you weren't the driver. You fill this in and send it back. That is all

    I own the vehicle but was not driving at the time. What do I do?
    · The Statement of Nomination of Name and Address of Driver section (see reverse of notice) must be completed by the owner of the vehicle with the name and address of the driver of the vehicle on the date of the offence. The completed notice should be returned to the Fixed Charge Processing Office within 28 days of the date of the notice. No payment should be returned at this time as a new notice will be issued to the driver. It is the responsibility of the owner, not the driver, to complete the notice
    · If the Statement of Nomination of Name and Address of Driver does not appear on the reverse of your notice, this indicates that the driver was stopped in person by the detecting Garda at the time of the alleged offence.

    You can ask them if they have a wider photo of the vehicle, which would likely identify the driver.
