With iOS 8 about to drop I expect there'll be a flurry of enquires over the next few days from people who bought used iPhones on Adverts etc over the last year, but weren't aware that unless the seller removed the device from iCloud they won't be able to activate their iPhones unless they can contact the seller, who may not have been aware of this and sold the phone on in good faith.

This was the case with iOS 7 too - Find My iPhone must be turned off before you can Restore (ie. wipe the device and re-install the firmware).

When selling an iPhone the seller doesn't have to remove anything from iCloud. They just have to log out of Find My iPhone to disable Activation Lock. Most people restore a phone before passing it on or upon taking possession, so whether this has been done or not quickly becomes apparent.
