survey phone calls

    what is the situation re getting calls from a research company doing surveys.they told me before they pick the number at random. i got another recently and that seems very random. Is there an opt out. the number is ex directory

    Is a phone number personal data?

    Strictly speaking. it's not personal data by itself but could be if combined with other data. However, the Data Commissioner deals with random unsolicited calls by different legislation.

    how can they stop it if the calls are random. are the companies given a list of don't call numbers?

    your link says "Non-marketing calls (including certain types of market research) will not be subject to these regulations." i think my calls belong to that.my phone company has my preference not to get cold calls

    They are supposed to consult the list. Just tell them not to call you any more then.

    I am also on a list with my phone company not to receive cold calls and I still get the odd one or two. When I queried this I was told if the company ringing you is from outside Ireland they are not bound to any rules.

    This seems to be explained on Boards on a relatively regular basis? But still - no, the survey companies are not subject to data protection law, because they do not engage in sales and marketing. They do have software that randomly generates numbers. If they were to maintain a list of numbers randomly dialled for future use, that would be different. It wouldn't be random, and I would question if they could then be subject to data protection law (I wouldn't be confident the answer to that is yes, though.)
