Casual jobseekers - working extra day for free?

    I'm contracted for 3 days a week and also claiming Jobseekers. If I work an extra day I loose my jobseekers payment for the week and a days overtime pay is much less. My manager claims that if I work the day for free, and get compensated from the company by going home early on my other normal working days, then she can still legally sign my jobseekers docket to confirm I only worked 3 days in the week.

    My issue with this, aside from the fact that I don't like to work for free!, is that it clearly states that to be eligible for jobseekers payment for the day I must be not receiving pay for the day from work AND be actively seeking employment, which I'm clearly not if I'm in work!

    Is this sort of thing legal?

    I believe you must be available for work, if your working a day for free or not you won't met the criteria. If you could work "free" days wouldn't everyone be at it and claiming the dole while claiming extra for the days they worked. Forget about the scheme, you'll get some looks from the dole staff explaining it and they'll be paying extra attention to you in the future.

    It's nonsense.

    For example, let's say you worked Monday, Tuesday, Wednesday for €100 a day, and Thursday for free.

    Guess what? You actually worked Monday, Tuesday, Wednesday and Thursday. Your payment for the four days is €300. And all that really matters to the dole office is you worked 4 days.

    You won't be entitled to jobseekers allowance. If your take home pay is too low for those 4 days, you might be entitled to apply for an income supplement.

    Now, if you read between the lines, it sounds like your manager is telling you she will sign a docket saying you only worked 3 days, even though you really worked four. That would be fraud & that's illegal.

    I think it is disgraceful your manager is encouraging you to defraud the system.

    She may be confusing things with someone that is permitted to work up to 20 hours per week. In that scenario days & hours can be altered on the work schedule once the total hours she confirms as worked are in fact correct.

    In your situation she can't do that. Three days is three days - no loopholes. She can't lie. I've yet to come across a situation where a person (well an ordinary member of the public) can legally lie or defraud or be complicit in defrauding a government dept. If she were to do so & you were to comply with her request your claim could be in jeopardy.
