Divorcing my American Husband from Ireland

    Hi,
    Im an Irish citizen and my American Husband and I amicably separated over a year ago now and I want to start divorce proceedings from Ireland where I am now living . We got married in America so do I have to go back there to appear in court for the divorce or can I do it from here? We have no children or property.

    You can divorce him from Ireland but it is a little more complicated than if both parties were in Ireland.

    If the respondent lives outside the European Union you must apply to court, before you issue the Family Law Civil Bill, for leave to issue and serve the necessary documents outside Ireland and directions as to how you must serve them.

    I'd imagine also( though I can't find anything online specifically) that you have to follow Irish rules. E.G. be separated for 4 years.

    Go to the family court website in the jurisdiction in which you were married, and ask them how to petition. You can be present by phone or skype. The clerk should be able to help you.

    This sounds good advice, it's got to be cheaper and quicker as well. Also in Ireland I think you have to be separated for 4-5 years before you can divorce.
