Who is liable for repair?

    Driving home today a truck in front of me hit a branch which fell in front of me. Having no chance to stop or swerve without hitting an oncoming car I ran over it. It damaged a bracket and punctured a tyre. I'm a bit of a worrier when it comes to the car so took it to the garage 2 mins away. They did the repairs and gave me a bill. After contacting the van company I was told they'd call me back after speaking to the driver tomorrow.

    Am I being fair expecting the company to pay or should I suck it up?

    Wait to see what they say...it's a bit of a tricky situation to be honest; I reckon anything they give will be a good will gesture.

    Could be one of those "you should have kept enough of a distance behind to allow for emergencies" situations

    Yeah I guess so but to be honest I wasn't that close and if I'd have slammed on brakes I would have been rear ended. It's a bit of a dodgy section of the road.

    Just a bit annoyed I suppose as it could have been nasty.

    You'd have been in a better position had you been rear-ended.
