Hi folks looking for advice on a car parking issue.
Basically i have a car which iv have been unable to drive for a year because of current medical condition. The car is in an under ground private car park in an apartment complex to which i pay for the space, however because im unable to drive it at the moment i never renewed tax or insurance ( since last oct ).
Today i was informed by management company i have 14 days to resolve tax & insurance or it will be removed by NCPS,question is if im paying for my parking space & it's not in a public place can they legally remove what is my property.

    I wouldn't have thought so.

Surely if you're paying for a space you can put whatever you want in it (within reason)

Tax is none of their business but I can see their point on the insurance, should anything happen your car, fire or theft for example, their property is at risk. I'm really not sure that they have any entitlement to move it though.

Have you asked them where they are going to put the car if they remove it from the basement car park?

They probably use NCPS that have noticed that lack of tax etc and are worried it's abandoned.
If you are paying for the space you should be able to declare car off road and still keep it there.

No Biko they know it's not abandoned as recently had to re register the gate fob & car parking space to space number with security.
In fairness the lad who works for the management company knocked on my door today to give me a heads up.

you pay for a space in a private car park. You can put a tarp over that car and leave it there as long as you want as long as you are paying the rent. You can tell ncps to go fcuk themselves. As long as you are paying the rent.

Id be seeking legal advice but Im fairly certain that NCPS towing a car amounts to car theft. They dont have a legal right to tow cars.

Aren't the management company appointed by the residents? Is there any precedent? Are there more unused cars there?

Are you up to date on management fees?

Yeah another car close by got a similar notice today as well, however there have been other cars by residents that were left unused for a good while before but im not sure how they were dealt with.As im a tenant it would be the landlord ( who will be getting a call tomorrow ) who would have a say on the management company

Edit : yeah all up to date
