Guardian (orphan) payment

    Hi all,

    Bit of background information.

    My husband's nephew was abandoned by his parents at a young age. My husband's mother looked after him in his home country (in Africa) until he was she passed away. He then came to Ireland when he was 12 (he is now 14) and stayed with my husband's sister (his aunt), so that he could get a better education and life. My husband's sister has now decided to leave the country for employment reasons and the child cannot go with her until he is 16 for immigration reasons. She has signed a Power of Attorney over to my husband in relation to the child. My husband will be his guardian until he can apply for citizenship and leave to go and live with the aunt and her family.

    The Department of Social Protection (Guardian Section) said we should apply so I am assuming we have a case for the Guardian's payment except there are two things that may be an issue:

    1. You need to provide independent proof of abandonment - would the Power of Attorney from the child's aunt to his uncle suffice?

    2. The child is actually going to be staying with a friend of the aunt as he would be in a better family situation with other kids going to the same school, eating the same African food etc and I have a medical condition that having him live with us, would put a lot of strain on. We are a young married couple.

    My husband will be providing for the child the entire time he is his guardian, clothes, books, trips, pocket money, grocery money etc to the family he is living with and will be seeing him on weekends.

    Would anyone have any advice? Do you think we will be awarded the payment in light of the above?

    I'm not sure your husband would be entitled to any payment as the child would not be living with him. Would I be right in thinking that? I think what if any, money should be going to the family he'll be living with.

    Have you checked this with the Citizen's Advice? They might be the best to advise.
