Disability Allowance disallowed

    Hi guys. My uncle applied for this back in October last year and was refused back in February. He sent in an appeal then and has just got word back saying it was disallowed. The reasons both times were because his partners income was over the means test limit. However his partner has recently moved out and he has told the appeals section this but they still refused him on her income. On his letter today it says because his circumstances have changed he needs to reapply. Does anyone know does this mean he won't get his backpay if da is granted from Oct and will the new application be deemed to have been received now rather than oct 13?

    He will not be backdated to October as at that time means in excess would have applied due to his partners earnings. He should re-apply and ask for it to be backdated from the date his partner moved out. It will also be investigated to make sure that his partner didnt just move out to avoid means being assessed for your uncles DA.
