Can he refile straight away?

    Bit if back story I have a beautiful 21 month old daughter and her father resides in a different country. We are both Anerican and never married and he is on her birth cert. only in June did he get around to filing for guardianship and visitation. He found out I have hired a lawyer and he is telling me he will ask to continue the case as he finds that I have given him short notice of allowing him to save up for one. Also back in March we had a hearing for maintanence and the day before he faxed the court stating he could not make it due to work. The judge allowed it and it got heard in June instead. Does he have ground to postpone? If not he said he would drop the case and refile straight away? Can he do that or is there a waiting time before you can refile?
