Posting people's registrations online / pictures of their cars

    Is it legal ?

    Could you be sued?

    If it's in a public place. Would supermarket car park accessible to the public be considered a public place?

    I want to take pics of offending cars parking in disabled places and post on FB page

    Anyway, I'm not interested in what you think of my idea, I just want to know how legal it is.

    So get a solicitor. This is a discussion board, not free legal aid.

    You could be open to a defamation claim, there could be privacy and data protection issues.

    Data Protection as always could be an issue, but I'd say only if this related to personal data, ie someone's image. Hence, offhand, a picture of an empty car with would be okay, but one with people in it or material that could id the owner might fall foul.

    Why don't you just report offending cars to the Gardai instead of looking for 'likes' on Facebook?

    There was a 'bad parking' thread over in Motors that ran for years and featured literally thousands of photos of cars badly parked, all with registration numbers visible.

    Park a car legally or otherwise in a public place, what right do you have to privacy if all that's posted on a website is a photo of the car?

    I'm not looking for likes thank you very much.

    Gardai have no jurisdiction in supermarket disabled spots.

    Even if car was blocking a private driveway the gardai still wouldn't bother doing anything.

    Hey now, there was a lad who dodged tax and was involved in criminality but didn't sell drugs who got his privacy improved by google.

    If he parks his jeep* badly his numberplate is private


    * might not be a General Purpose vehicle, might be a High Mobility Multipurpose Wheeled Vehicle

    If it's parked in a public place, thousands of people will pass it each day, posting a photo of it on a FB page or internet forum like boards will only expose it to a few hundred people who bother to look at it and the vast majority of them won't know who owns the car or is the registered owner or who actually parked it where the photo was taken so I really can't see how a photo on the internet could give cause for an action for defamation.

    It's the posting with a tag illegal parking or on a site only for illegal parking. I am currently standing outside a courthouse any one who passes will think noting of it on the other hand a picture of me outside the self same courthouse on a site for persons accused of theft is a different matter.

    If you offered me €1,000 I couldn't tell you the registration number of a car owned by any of my neighbours or any member of my family so I really can't see the point. A friend of mine has an ex-demo car which has a registration number which ends in four zeros but I can't remember the year or the exact number.

    So OP, go ahead and post all you like, I doubt if anyone will recognise the car and if they do, it will probably only reinforce their view that the owner is a selfish asshole who doesn't give a sh1t about the disabled or anyone else.

    That is correct, shopping centres can paint yellow boxes, disabled bays etc. but that type of signage is only enforceable by the Gardai if it's put there by the local authority.

    In a hospital or supermarket car park you could be clamped by a private company if you park in a disabled bay with no blue sticker but the Gardai can't do anything about it because you're not breaking any by-laws.

    Certain RTA rules do apply like the requirement to have driving licence and insurance because the likes of a hospital or shopping centre would be open to the public with vehicles and hence a 'public place' according to the RTA but anything that relies on signage (including markings painted on the ground) cannot be enforced by the Gardai because there's no by-laws behind them, they are there solely at the behest of the owner of the property.
