Night shift on bank holiday Monday

    Hello all,

    Quick question, I am working a 12 hour shift from 8pm Bank holiday Monday, would I be entitled to any extra pay?

    Depends on your company's policy on salaries/wages. But I'd say yuo'll get paid double from 8oc to 12oc.

    Cool :) and do you think I would get 8 hours pay for the bank holiday as well? The last company I worked for paid you for 8 hours even if you didn't work on the day but I don't know if every company does this..

    You'll get paid a flat rate for 8 hours and an extra 4 hours flat rate for the 4 BH hours you worked imo. Anything extra, look at it as a bonus.

    Where I worked, if you were rostered on shift work, the only overtime you got was if you worked beyond the 12 hours. If your roster fell on a bank holiday, you didn't get any more.

    You're entitled to a day in lieu. As you are entitled to be paid for the Bank Holiday if you are not working, 40hours must be worked in the 5 weeks up to the BH must be met, and you get the average payment over the last 13 weeks per day.

    Night duties that straddle midnight often cause difficulties for people in relation to bank holiday entitlements. What will your colleagues who work the night before be getting?

    I would say that a reasonable interpretation of the WTA would be that you are entitled to 4hrs (8pm-midnight) at double time while your colleagues on the night before are entitled to 8hrs double time.

    If you receive payment for the hours worked you are not entitled to an additional day in lieu under the legislation (but may receive better treatment under your contract)

    It really would not be in the spirit of the legislation to award a full 12hrs double payment in both instances.

    But the legislation doesn't specify how that has to be paid.

    I use a 13 week period though your right no mention that I can see of 13 weeks.

    E.G.

    Part-Time Employee works for 50hours in the 5 weeks up to a BH
    They are paid 10euro per hour
    They have worked for 130 hours in the last 13 weeks
    Average Daily pay is €20 and this is what is paid to them for a BH if they work it or not.
    If they work the BH they get €40 for 2 hours work (or 20 euros extra e.g if they work 6 hours they get 80 on a BH).
