    Hi im a newbie here. I was looking for some news on <SNIP> company. We have our property for sale with them and have paid 1500 euro. It's a joke, all I'm doing is ringing them and getting lots of sales talk. An interesting thing is I was dealing with one particular sales rep who has since left and moved on but I wss last to know this <SNIP>. <SNIP> .Can anyone help we really need to get our money back.

    I doubt if I know enough to be able to offer help, but it should be noted that law and practice vary greatly between states, so it might be relevant to know in what country the problem arises.

    Hi its an irish company and our property is in portugal.I was thinking of going down the small claims route.Im going to try and contact this company director again tomorrow dosnt seem to want to talk to me.

    The thing with the Small Claims Court is that you have to first exhaust the company's dispute process and be able to show it.

    I suggest you write to the company; outline the reason why you're unhappy with their service, their unsatisfactory responses to your calls and then clearly state what you expect them to do (i.e. refund your money). Let them know you will take the matter to the SCC unless they agree a satisfactory resolution within reasonable amount of time (10 working days should be sufficient). Send the letter by registered post so that there is a record of delivery and keep a copy for your own reference.
    Do you have a written service agreement which details their commitments? It may strengthen your case if you can should a failure on their behalf but bear in mind it might go against you if they can show they are abiding by the agreement but the market is not performing as expected.

    While I'm not sure exhausting all other avenues is required of the Small Claims Procedure, it's certainly a good idea. Is there no regulatory body in play here OP?
