    How did you pay?

What contact details of his/hers do you have?

Do you think they knew it was fake?

Em yes i do but im gonna give him the benefit of the dout tomorrow i will ring and politly but firmly let him know and see if he wants to do the right thing, but after that if he dosent want to give me my money back what powers have the guards in this case, his add is still up too

Get a friend to call and enquire about buying one. If he still has it for sale there's a possibility he's deliberately selling the fake phones for a profit. If he still has them let your friend go and look at one and if the one he tries to sell is fake then you show up and ask for your money back. There's no way he can deny it then and you can call the guards to attend if he won't give you a refund.

He withdrew the phone so it was just the one.. Maybe he got stung himself but anyway he ripped me off not stating it was fake.. Im gutted I bought it, i wonder though what powers the guards even have an if they would bother in such a deal

Say your out of luck because he can claim ignorance if you show up. If he doesn't willingly give you a refund there's nothing you can do. The guards won't want to know because it's your word against his.

Although too late now, next time put the IMEI number through http://www.imei.info - if it's fake, the IMEI will come up as a cheaper model or a totally different make of phone.

You can sue him if you like.

Proving that the seller knew the phone was fake would be his word against yours.

    Why not?

Sounds to me like a pretty good case.

We have a witness and victim.
We have the offender and his address.
We have an exhibit the phone most likely with one usable print.
Somewhere there should be a copy of the ad with no mention the phone was fake.

Then again it all depends on the magistrate
