Clamping Appeals and processes

    Hi

While attending a walk in medical centre in a suburb in Cork City with a sick child, we parked in an official parking spot and had our parking ticket displayed. Bearing in mind that this was after 7pm in the evening and dark in a poorly lit area. When I left the medical centre 45 minutes later, my car was clamped.

The clamping company proceeded to charge me €165 to un-clamp the car at 8pm while I had 2 young toddlers with me. The employee who un-clamped my car had no interest in seeing my ticket, only to hand me an appeals form.

I have appealed this decision with evidence of my parking ticket and medical receipts to the clinic. However the clamping company have flatly refused my appeal and directed me to IPAS (Independent Parking Appeals Service) who then charge an additional €20 for this secondary appeal.

Their website appears quite unofficial and very Vague on what warrants a successful appeal.

Has anyone gone through this process and how did they find it

If you were parked legitimately and can prove it, I'd be heading for the Small Claims Court.

Haven't been clamped, can only sympathise. Could you send in evidence like doctor's note, in addition to receipts? If you have a good case might be worth the €20.

Should have called the guards and have them note the time of call and complain that some jack-ass has unlawfully clamped your vehicle.

I got clamped like your self at start of this year and after a few months of pestering them they decided to give me my money back:D

TBH I didn't think I was going to get my money back but I decided I would just annoy them and try and tie them up with with emails asking for the legislation they operate under, rules & guidelines, codes of practice, local bylaws etc etc anything I could think of. My aim was to get a bit of sport out of it and see could I clock up enough of their man hours replying to my emails to justify the €165 they took off me.

So my opinion is don't go into this thinking that you are going to get your money back but have a bit of fun with it;). Just keep send them emails asking for information they will try and ignore you but just send a gentle reminder that you are not going to go away and sure you`d will never know.

Firstly there is no independent parking appeals service, it's owned and run by the private champers.

Secondly, if it was a HSE site, I would write a complaint to the hospital manager.
