Life interests question

    A testator leaves a life interest in his property to his children which upon the last surviving childs death, is to be sold and the proceeds are to go to the next of kin of the testator.

    Does the 2009 act affect this sort of Life interest?

    Would you be better off setting up a trust so that the executors hold in trust for the benefit of the testators next of kin?
