How long can you claim 'sick leave' for after Maternity leave?

I was employed to cover Maternity leave, but have been kept on a number of months extra as the woman is turning in '1 month doctor notes' the day before/on/the day after the day she's due back.
Just wondering how long legally can this go on, and anything else I should know regarding the subject!

Kind of depends on the employer. Some limit the amount of sick pay they will pay to an employer (some do not pay anything) so when the employee is off sick, they just get what ever the state pays. In theory the employer could (eventually) terminate the employee.

Is this Public Sector, or Large Public Company ?

Employer is not paying anything towards sick pay. It's a small, family run business. Was just wondering legally is there any limits, or totally up to the employer?

Normally after a while the company will send the employee to a company doctor but with a new mother its a mine field. With sick babies and post natal depression you don't want to be insensitive or leave yourself open to unfair dismissal.

After a period (might be two or four years) you would get some additional rights as an employee, there is a limit to how long they can keep an employee on a fix term contract.

What's important here is that there's a process and that it's clear to the employee as part of their work conditions, i.e. contract. Once there's a process, it must be followed and applied equally to all.

If the above is done, it doesn't matter if it's a female employee with a new baby or not.
