Photos for court query

    Hello all, just a quick question if anyone here could help.
    If you needed photos of an injury for court, is there someone specific that needs to take this photos in Ireland? I was speaking to my friend yesterday and she said the court would not accept a persons own photos because they could be photoshopped. I am just wondering if this is true. Any information would be much appreciated.

    You didn't say what kind of case. If they are evidence in a criminal trial then they would likely have to be taken by the Gardaí, although not in all cases. For a civil trial it would probably be ok.

    Its all about chain of evidence. If its a criminal case the Garda probably would have taken photographs. A medical report will usually also be required which will describe the injuries in medical terms. You don't say whether its a civil case or a criminal one?

    Sorry I meant to reply to this. It's a possible medical negligence case. incorrect medicine was used, this caused burns that are changing over time, but the photos were just on a family camera.

    In a medical negligence case a doctor must give the required evidence to prove negligence. Photos will only be evidence of a reaction and will not prove negligence, or prove the cause. Such cases should only be considered with the aid of a solicitor.

    Sorry I meant the law was a complicated area, not that the burn was in a complicated area!!! Haha.

    In general a person can use photos they took as evidence.

    The person who took the photographs needs to be available to give evidence as to where and when the photographs were taken, and as to the fact that they are as taken, and have not been tampered with. If you haven't got that evidence, the other side can object to the admissibility of the photographs.
