Incapacitated child credit rebate

    I've been approved for the incapacitated tax credit but as I was not working in 2013, I didn't pay tax so they obviously can't refund me the 3.3k for that year.

    Can his dad claim the credit / refund for that year?

    Hi folks

    I have a son who was diagnosed with Autism over 2 years ago, but we knew this was a conditon he was born with and the diagnosis was only confirmation really. He is now 6.

    We only found out about this tax credit a few weeks ago and it appears we are entitled to claim for the last 4 tax years (2011, 2012, 2013) and the current year which ends this week. I have checked the criteria and it looks like we qualify, I also paid income tax far in excess of 3.3k per year, and I will be submitting the completed claim form in early Jan.

    I also understand that the monthy tax credit will come into effect from 2015 by my employer.

    I have a few questions and I would be grateful if anyone in similar circumstances could offer any guidance.

    1/ Does the tax rebate for the 4 years (if you are claiming backdated) amount to €3,300 per year,or is this a percentage of your tax rate (41% for eg), so would it be the full €3,330 or just 41% of that figure per year?

    2/ Similar to when the credit is applied by your employer, is this €3,300/12 (275) per month, or again is is only 41% of that figure (€112.75)

    I would be very surprised if Revenue are going to refund me the full €3,300 x 4 years, so I'd be very interested to hear of any of similar claims that anyone had.

    It's backdated to birth. They may try to ask "When did you first notice" or something of the like, but just advise (truthfully) that they were born with it. If they were born in june of the year, it's 6 months for that year, if december, only month of that year etc. You'll be getting the full rate I believe, not taxed at 41%.     They will refund you the 4 years credit and amend your tax credits going forward.

    The next 2 months will be the busiest few weeks of the year in the PAYEanytime service, so it could be several weeks.

    They're also likely to look for the relevant medical confirmations/opinion to support the validity of the claim, so that'll add to the time it takes.

    If you're intending on claiming for 2010 the claim MUST be made by 31 December, they're v sticky on this. Although, if you've only got the diagnosis in 2011/12 then that could be a problem (I'm speculating on this point).

    We will be claiming for the 4 years starting 2011, ending 31 Dec 2014.
    I did read since that Revenue have queried dates of diagnosis on peoples claims, ours may be only 2 years old, however we have a doctors report backing up that it was only the official confirmation and it was a condition from birth. Also this would apply to all parents of autistic children.

    I am expecting revenue to try and only award 2 years so I'll be ready for that if they do and we will submit further back up if they want.

    I also take the point on the busiest time of year with them, so I'm prepared for a delayed process and payment.

    Have your doctor's letter saying condition is from birth and permanent. Also send it registered at this late stage.

    Why aren't you claiming for 2010 though?! Get your finger out and your claim in... :cool:

    You can only claim for 4 years backdated, so this can only be for tax years ending 2011, 2012, 2013 & 2014.

    I will send it to Revenue in early Jan, then my employer can apply the credit from 2015 on a monthly basis.

    We're just waiting for our GP to complete the claim form we left in then it should be good to go.

    Yes meant to say we also have a doctors letter saying the condition is from birth. hopefully that will be fine for the claim.

    Exactly, you have 4 years from the end of a tax year to make a claim for repayment of tax. Hence you have until 31/12/2014 to make a claim for 2010 tax. Seriously Bryn, get something, in writing lodged to Revenue tomorrow..!!

    Got all this sorted now in terms of my application, form has been returned back from the GP and I rang Revenue, all good to claim back 4 years and they confirmed it will be the full €3,300 per year not 41% of that.

    Hi folks

    Does anyone know what figure you should put on the question 'The yearly amount contributed by you towards the maintenance of the child' (bottom of page 1 of the claim form)

    I`m assuming this is left blank and is only filled in if another person is entitled to claim on behalf of the child?

    Just make sure you have pad enough tax to reclaim the year you are apply for. I applied for 2011-14 but hadn't paid much tax in 2012 due to maternity leave so I didn't get refunded for that year. The refused to refund my child's father unless we could prove court mandated payments?!?! We are down 3300...

    Thank CaraMay, our situation is married one income, and I paid far in excess of 3.3k each year, so looks like they will pay me rebates for 2011-2014.

    That's a real shame you didn't get paid for 2012.

    We only found out about the tax credit in December and at that stage we didn't have the GP letter.

    I was only aware you could go back 4 years in total, and that wouldn't include the current year, ie if I had the GP report in time in late Dec (I hadn't) would that have meant claiming for 4 years back PLUS 2014?

    If it was, then I missed the boat and nothing can be done now. Revenue have since confirmed I am entitled to claim for 2011, 2012, 2013 and 2014 and my employer will apply the credit per month with effect from Jan 2015.

    If I missed a year so be it, but since we only heard about this in Dec and only got the GP letter back in early Jan, it was always going to be tight. Besides, if we get 3.3k x 4 years and the credit of 275 applied per month with effect from Jan, I'll be more than happy.

    I updated my message, see edited, wasn't aware we could apply for 4 years back plus the current year.

    Timing was very tight in any case as I didn't have my application complete until early Jan.

    I told you last week that you could, and then on the 29th I said to you:
    Exactly, you have 4 years from the end of a tax year to make a claim for repayment of tax. Hence you have until 31/12/2014 to make a claim for 2010 tax. Seriously Bryn, get something, in writing lodged to Revenue tomorrow..!!

    3,300 down the swanny - all you had to you was have something, anything, in writing saying you wished to claim the credit for 2010, stamped received in your tax office on or before 31/12/14... :(

    Ah well it's my loss. I totally misunderstood this, and thought 4 years back was the limit regardless of the tax year.

    At the end of the day I knew nothing about the rebate up to last month, so if they pay me 4 years x 3,300 I'll still be happy.

    Thats fine guys, and thanks again for the advise. I wasnt following the thread too closely over the end of December period as we had a bereavement in the family, and it was my misunderstanding about the 2010 year claim .

    I however rang Revenue this am, explained we were unaware that if it was sent in Dec 2014 this would have allowed an additional year (2010), on top of the 4 years backdated and the delay was caused by the GP who had not yet returned the form to us.

    I pointed out that the GP had signed this on 24/12, however we only got it back on 02/01, and they said if I confirm that in another letter, they will include 2010 as an additonal year now. They also said if I had sent the form in without the GP having completed it, they would have considered it as incomplete.

    So alls well that ends well now.

    Hi all

    Just to close this out. My application only went into Revenue on 4th Jan and it was fully processed on Friday 16th. They paid me for 2010 and 2011 already, and same will go through for 2012 and 2013 early next week. The final year for 2014 will be paid when I send them in my p60 at the end of the month. This is the full 3.3k per year, and they have also made adjustment for the additional tax credit of 275 per month from Jan 2015.

    Top class service from Revenue, and anyone reading please pass on to any friends or anyone in similar circumstances, this is your money waiting to be claimed.
