any chance you'll quote that article for everyone and back up your point with some caselaw?

im not aware of any case law.

mabe this needs a solicitor who practices in the constitution to clarify the question.

I still don't accept customs have the authority to enter someone's private property without just cause..

Sounds like some of that freeman of the earth stuff to me.

read article 40. personal rights.its all there.

in accordance with the law they have no right to enter ones private property at will.
    that would be unlawful.
Have you ever read it? Article 40 of the constitution explicitly states that private dwellings can be entered in accordance with law.

they used to turn up at rural car parks and the like and dip the tanks if I recall

can't do that anymore with the locks

Customs have a checkpoint between Balbriggan and Swords on the N1 around once a month, I've even seen them have a 2nd checkpoint further down the road on a few occasions.

can't do that anymore with the locks I thought barges were exempt.

Speaking of barges it's worth noting that all diesel boats on the canals, Shannon etc. run on green. They are supposed to make an annual return to Revenue and pay the extra duty.

Yup. Same in the UK, they pay the "Mineral Oil Tax" although they differentiate between commercial waterway traffic, which can use red diesel away like tractors, and private pleasure craft. There was talk here of mandating white diesel for all waterway traffic, with VAT rebates for commercial users.

They seem to go through phases where they have checks on the R132 near the Donabate roundabout, in that they'll be out every week for a month, and then not back for a while. Last time they were doing it, it looked like they were pulling over every diesel vehicle and checking.

I have been driving daysul cars now for about 15 years, I have yet to be dipped at a checkpoint. I havent even seen one in the last 2 yrs.
But.. My ex wife used to have a commercial discovery and she was stopped and dipped about once a month.

They use profiling to stop vehicles most of the time so anything that looks like it does high mileage will get stopped.

What's the story with the auld TVO? could that not be used with a switchover to petrol for when you get stopped by the customs man?

Serious question, does anyone use TVO for anything these days. I haven't seen a TVO burning yoke since I was in short trousers.

But if they find only clear taxed diesel, what then?

Do they pay for car to be repaired?

Oh Crap! Bought a 4x4 last November that had previously been owned by a farmer. Done 11k miles since, how likely is it that I might get done?

Been having problems with EGR valve as well...

    Seriously????

They do set up the check points in the most random places.
Last one I saw was in Knocklyon, outside the entrance to a football pitch on the short stretch of road between Ballycullen Rd and the M50.

Don't forget lads they can show up at your house at 6am to dip. Also they can dip you when unattended, they can break your filler cap if necessary.
Tell that to people who it has happened to. Customs can do whatever they like and that's your problem.

I know that C and E have a lot of powers.
Do you actually know someone that this has happened to, or is it hearsay?
Because I find it hard to believe that they would just turn up at a random house at six in the morning to break the filler cap off a random car / van without good reason or suspicion.

All checkpoints though. Not out just for me.

They love the N2. Nice straight road and bog all turn offs.

Plus it runs right through Co Meath, a farmers heartland and onto Monaghan where a lot of laundering operations are located. I could be wrong but my impression is that you are far more likely to be tested on the N1,2 and 3 than you are on the n4,7 or 8.. I'd also say that there are lots of rural areas where you are highly unlikely to be tested. In fact I'd almost say you could look up the list of Customs and Exise sub offices around the country and if you live more outside a sixty mile radius of one of their sub offices and you're in a rural area driving mainly rural roads then the chances of ever getting caught are pretty slim.
