Solicitor struck off who was dealing with my house purchase.

    Hi,
    I've been contacted by a firm of solicitors who informed me that my solicitor who was dealing with my house purchase has been struck off the register.
    They have said they would like to help me proceed with my house purchase for a fee of course.
    My question is, my house is registered with the revenue, the bank has everything and the sale went through as per the property price register what else is there to complete.
    Is there something I'm missing? Their looking for €600 approx and inform me I can claim it back from the law society once I make a claim against my previous solicitor.
    Any advice

    That firm of solicitors is touting which is not allowed. You should get their details, record their calls and complain to the Law Society. The firm who contacted you should be struck off as well. They are obviously chancers. Do not have anything to do with them as regards your house.

    When a solicitor is struck off, all his/her files/cases are transferred by the Law Society to a new firm.

    This is not touting, nor arm-chancing.

    Ask them what remains to be completed.

    Did you owe your old solicitor any outstanding fees?

    When a solicitor is struck off, all his/her files/cases are transferred by the Law Society to a new firm.

    This is not touting, nor arm-chancing.

    Ask them what remains to be completed.

    Did you owe your old solicitor any outstanding fees?
    The law society gave my file to them to contact me.
    No fees are outstanding with my previous solicitor and everything was paid up.
    Since my first post I received an email outlining fees and asking for my instruction to them.
    The only thing they mention is the my registration was not complete and that they would like to complete it on my behalf.

    You mean the title to the house isn't yet registered to you?

    That's something you'd want to get sorted...

    Call the firm and speak to them, ask them what needs to be done and if it is necessary, there won't be a charge for a simple phone call. if the registration was not completed it will need to be done.

    That's the problem, they claim they are unaware due to the fact that they are not allowed look at my file as I have not authorised them.
    They want a fee upfront and then me to sign off their permission.
    Only then can they say what is wrong according to them.

    Check www.mypropertytitle.ie to check if it's registered.

    op the exact same thing happened to me. I got a letter from the Law Society telling me that the solicitor that I had used in a house purchase years before had been struck off the register. They said there was unfinished work on my file. As this had happened maybe two or three years before and I hadnt heard that anything was wrong I actually ignored this letter.

    Fast forward a year or two later and I wanted to remortgage and I couldnt. The solicitor had never registered the transfer and mortgage in the land registry and because of this the bank had never got the title as security.

    I had to nominate a solicitor to sort things on my behalf and pay for it myself. I was informed by the Law Society that I could make a claim from the compensation fund for lost money. I eventually got all my title issues sorted but the solicitor I used to sort things really wasnt interested in making the claim on my behalf and just left the matter there. I was down over 1000 euro and couldnt afford it so I contacted the Law Society and made a claim on the compensation fund myself. In order to do this I had to pay my fees in full to the Solicitor and once I did I took back my file as it was my property and I then used the information contained within in to prove that the struck off solicitor acted dishonestly in charging me fees and outlay for work that was never undertaken. The Law Society awarded me 1200 euro so I was glad that I made the claim in the end.

    You really dont have any choice but to sort this out if you ever plan to sell or remortgage your house! I would imagine that the Transfer wasnt lodged in the Property Registration Authority and that a lot of the 600 fee is in relation to registration fees. If you do not trust this firm of solicitors you can nominate your own to work on your behalf, ring the Law Society regulation section and ask who has been nominated to take over the conveyancing files of the Solicitor you used who was struck off.

    One thing is for sure make sure that you claim that fund the money is better off in your pocket than theirs but dont ignore the issue ! hope this helps from someone who has actually been through the process. also as another poster suggested look up mypropertytitle.ie and you will be able to see if the house is registered in your name and also if the mortgage is registered (if you have one) my guess is none of this work has been done ! the fee to look at your folio if only 5 euro
