Planning exempted extension

    Hi,
    My brother recently bought a small mid terrace house and is considering building an extension to the rear of the house (extending out the kitchen). We are keen to avoid planning so are trying to satisfy all the conditions, i.e under 40 sq.m etc. Could someone clarify these things I read on citizens information:

    "If your house has been extended before, the floor area of the extension you are now proposing and the floor area of any previous extension (including those for which you previously got planning permission) must not exceed 40 square metres."

    -his house already has a small extension to the rear but we don't know when this was built- I would say the existing extension is about 30 years old

    Whatever the floor area of the existing extension is, if built after 1963, deduct that area off the 40m.sq. and then that's the area you can build a new/additional extension without planning permission.

    Unless, your proposed extension encompasses your existing extension then your 40m2 applied to the boundaries of the proposed extension.....

    Can I just clarify this and be sure i understand correctly. I've just bought a little cottage with an existing exempt extension. The extension was badly constructed and I intend to demolish it. Can I then put a new extension of 40m2 on to the back of the house and I will be demolishing the old extension and building over the footprint of it. I will basically be extending on to the old original house.
