DataProtection v. FoI request

    Is there a difference between a personal request under Data Protection Acts and a Freedom of Information request for personal data under FoI Acts .. when dealing with a State agency?

    The only difference I observe is that you can appeal a decision to the Information Commisioner with FoI. Anything else?

    I think it's basically the same thing?

    Obviousally FOI would have more details like searches, court appearances and any incidents you report to gardai..

    FOI - State bodies with some exceptions, e.g., NAMA and the Gardai. FOI doesn't have to be pertinent to an individual, can be issue based;
    DP - everyone else, inclusive of the State but relevant and limited to the person requesting.

    Both regulated by unique and specific statutory schemes.

    There is also the concept of "freedom of access to information on the environment", although the potential for personal information would be somewhat limited.

    To add, FOI also covers records which are held on paper; eg correspondence on the subject concerned, interview/hearing notes, invoices and bills and so on.
