    Your driveway is not a public place.

    That's about an IMRO matter, and not relevant to the SORD question. The RTA definition quoted above is, and it's very clear.

    yes but the area alongside a public road may well be, we don't know,he's obviously OK with a private drive

    I don't have a private drive.

    My land is at the front of the house but there is no separation from the public road.

    Memeber of the public wouldn't have permission to access it though

    If you own a strip of land outside your house, whether it is fenced or not, it is not a public place.
