bad experience with a company, - seeking advice?

    hi all

    ive had a peculiar and really upsetting... experience with a company, as yet i wont mention theyre name, because im not sure where i stand, and thats why im starting this thread, hope you dont mind reading.

    I asked a company to do a job for me, i needed an item modified.
    We agreed a price, and set a date for two weeks time. I said id ring him the Monday of the second week, to see how he was getting on with the job.

    So I rand him on the monday of the second week. He informed me that he probably would not get round to it that week (week two), but he would get to it early the next week (week three)

    So on week three i rang him, his Secretary said he was out, and that he would phone me back.
    I'm a pretty easy going person 99% of the time, so I left it at that. He didnt return the call.

    So now I'm at week four. I rang him on Tuesday morning, the Secretary said he would ring me back. I replied, - well he was supposed to ring me back last week and I'm still waiting... but alright, I'll wait, he can ring me back.

    no phone call.

    So we come to this morning. I ring, the secretary goes to talk to him, and comes back on the phone.
    she relayed some excuse about moving machinery, he wont get round to doing the job at all, can I come in and pick them up?

    Im fuming at this point. really frikking mad. I know its not the Secretary's fault. I said to her,

    this doesn't really reflect well on your company
    it's very unprofessional
    we had a contract, a verbal agreement

    she agreed with me and was polite, I said I'll go and pick them up alright.
    I am fairly livid about what he has done.

    These days i am employed, so have money. but the trade off with that situation, is that suddenly time is in short supply.
    This guy is after wasting my time for a month.
    I'm really fuming about it, and, I will go and scream at him. I've done it before, and ill do it again. Its hardly ideal, but it is effective.

    Whats also getting me is, that hes after putting me in this position, that i have to stand up for myself.
    I dont want to be battling these people. but I'm not about to be walked on either.

    So have you guys any notions, as to why what can i do, aside from abuse this chap? - which seems like a primitive answer.
    is there something cleverer i can do?

    I actually started a thread on boards.ie seeking information about who could take on this job. I really feel like going back to that thread and naming/shaming this company. Is that something i can do? Maybe also a small claims court..... better than getting into a confrontation anyway, and i get satisfaction.

    I'd leave it. If he's as unprofessional as you say, he'll hang himself soon enough. Without any help from you!

    Was your item damaged whilst in his care? That's all you need to concern yourself with for now. If it was, then that would be another story, but from your OP, I don't think that was the case.

    I totally understand your anger, I had the exact same problem this year, the contractor was coming this week, then the next week etc etc,fast forward 4 months...still no word from him...I have met him since in my work environment, so couldn't bawl him out of it unfortunately,I just said was he going to come & do the job or what, he said I will ring u next week, no call,so I am arranged another contractor to come to do the job. The annoying thing is, he must have come to my house at least 3/ 4 times to do quotes etc....GRRRRRRRRRRR:mad:
    Sorry I have no solutions for u,but I would be inclined at this stage to get someone else to do the job...

    You have no contract with the person, it's very annoying but you have no legal remedy to my mind.

    I'd go back to the other thread and state that one of the people recommended was useless and messed you around.

    Not much point screaming at the person either, just inform them that you'll be letting everyone you know about the poor non-service you received.

    This is why legal advice is not allowed here, because people frequently get things completely wrong. FYI, in a scenario like the OP's, without any more detail, there would be a contract.

    The OP may in fact have a legal remedy depending on the cost of subsequently having the service performed by another contractor. However, the detail and practical viability of this are things which only a solicitor can advise on.
