Backdated Illness Benefit - 6 weeks off

    Hi all,

    Need some advice here please.

    My wife broke her wrist back on Feb 17th and was signed off work for 6 weeks as she has a typing based job and couldn't move her fingers on her left hand.

    She'd never been off work this long before so her employer has never reduced her wage. On her return (28th Mar) her line manager informed her that her salary will be reduced 188 per week for her time off and she'll need to claim this back of social welfare. She was never briefed on this policy before and it's not in her contract.

    She spoke to her manager the day after her accident (18 Feb) and asked would her pay be affected and she was told if it was she'd be informed. Now she's in a position we she has to try and backdate an illness benefit claim as her April salary is going to be greatly reduced.

    She visited the Doctor yesterday and while the doctor could provide her with an MC1, weekly inter certs and a final cert the doctor seemed very skeptical about her getting anything back as it so late??

    Has anyone been in a similar position? On the welfare website it does state that it can be backdated with good reason (???) but it also states that the money may not be able to get claimed back (vague).

    Help much appreciated!

    On the MC 1 form there was an opportunity to explain why you are applying so late.
    Often the reason is that the claimant was too ill/badly injured etc at the time to apply.
    There is also the opportunity to have the €188 paid to the employer.
    The employer is entitled to this money if he paid your wife throughout her abscence.
    This is why it is sensible to apply for SW payments appropriately.
    Why did she not apply at the time?

    She didn't apply at the time as she was unaware she had to. She asked her manager will her pay be affected and was told she'd be informed if it was...which didn't happen until she returned to work.

    The employer has taken the 188 from her salary so she'll need it paid directly to her.

    OK I see. Did she fill in the form to that affect ? What reason did she give for not applying earlier? Mind you they are usually very lenient and they will probably just post her out a cheque.
    Always apply for benefits if your entitled to them.
