When I started taking a Lilly drug I developed epileptic seizures

    Hi,
    I have epilepsy since and have had to stop working and now I'm on a lot of medication.

    Is there any legal route I could go down for this?

    You need to speak to a good medical negligence solicitor, who will be able to tell you if you have a good claim or not. It really is not a simple issue, and without a lot of very personal medical information from and about you no one could answer your question.

    Has any medic told you that you developed epilepsy because you took this particular drug? The fact that the one thing was followed by the other doesn't, in itself, mean that the one thing was caused by the other. Unless you have evidence that taking the drug gave you epilepsy, you don't have a case.

    If you cross that hurdle, the next hurdle is showing that Lilly could, with reasonable diligence, have avoided the risk. Did they know the drug could trigger epilepsy? If not, should they have known? Had it ever been linked to epilepsy before? Were there any tests that should have been done, but weren't? Were there tests that yielded data that wasn't properly considered?

    Or, possibly, Lilly had identified the risk, and publicised it, but the doctor who prescribed the drug for you was negligent. Your case may be against the doctor, rather than against Lilly.

    In short, there's a huge amount of legwork to be done before anyone can say if you have a case here and, if you do, who it's against. First, you need medical assessment of your own condition, and an opinion as to whether there is any link with the drug you took. Secondly, you need to find out as much as you can about this drug, and the link with epilepsy. If other people have previously developed epilepsy after taking this drug, a good deal of the investigative work may already have been done; it might be worth your while to look around for support groups and the like for people who have taken this drug.
