definitive information on property boundaries

    Hi all,

    I was wondering if anyone can recommend what's the best way to demonstrate definitively where the boundary of a property lies. I would have thought the Property Registration Authority but looking at their maps online at landdirect.ie, there's a note:
    "PRA Boundaries and Plan Area are not conclusive. See Section 62(2) of Registration of Title Act 2006 and Rule 8(3) of the Land Registration Rules 2012."

    Any suggestions? Is it possible to look at actual deeds by visiting the Land Registry, and if so, can one view previous purchases before current ownership (to see, for example, whether land was misdescribed in one transaction so someone was essentially selling their neighbour's land)?

    I'd be really grateful for any pointers.

    Section 62 Registration of Deeds and Title Act 2006
    Amendment of Section 85.
    62.— The following section is substituted for section 85 (description of registered land) of the Act of 1964:

    “85.— (1) Registered land shall be described and identified by reference to the registry maps concerned in such manner as may be prescribed.

    (2) Except as provided by this Act, neither the description of land in a register nor its identification by reference to a registry map is conclusive as to its boundaries or extent.”.



    Rule 8, Land Registration Rules 2012

    Description of property


    8. (1) The description of property in the registers shall be by reference to the names and denominations recorded by Ordnance Survey Ireland and may, where the Authority permits, include any other geographical or locational information.


    (2) Neither the description of property in a register nor its identification by reference to a registry map is conclusive as to its boundaries or extent and a note to this effect shall be entered on the register.


    (3) Where areas of property are recorded, such areas are not conclusive.


    (4) The description of property shall be revised by the Authority from time to time and made conformable with the description on the registry map as and when revised.
