Problem with Solicitor

    Hi I'm hoping someone can help me. My family and I accepted an offer on our house in November. We also made an offer on a house around the same time. The only problem was, we needed to get my Dad made a Ward of Court as he has Dementia so we couldn't sell the house without it. Even though it has taken longer than expected, everything went smoothly and we're now at the point of signing contracts (finally). The people who's house we're buying are completely fed up now and have basically pulled out of the sale and returned our deposit all because our solicitor isn't cooperating. They say that she's not doing her job correctly and won't return calls etc. My Mum has done everything she can to try and get the solicitor to do what she's supposed to and she promises she will but then never follows up. We're at our wits end now as we had our hearts set on this house and we're about to lose it. Is it too late to find a new solicitor? Is there anything we can actually do to fix this mess? Thanks in advance for any help!

    First, there has been a long delay in relation to this matter.

    Secondly, I see that you mention that the seller has told you that the solicitor is not doing her job or returning calls. I also see that the solicitor has made various promises to your mother, upon which she has not delivered.

    Despite this, it seems unclear to me whether your solicitor is at fault for the transaction falling through, or whether there was another reason. The seller is/was a party to the transaction. Therefore, he cannot be objective.

    Here are some options that may be of assistance:

    1. Meet the solicitor and find out what happened, as soon as possible. Perhaps she can offer an adequate explanation. If you are unhappy with the explanation, you can take advice from another solicitor.

    AND/OR

    2. Consult with another solicitor. He or she will probably need to take up your papers from the first solicitor in order to review them. When this has been done, perhaps he or she can advise you on whether matters can be turned around, and other matters.

    You may need to shake the branches a little and say that you are open to complaining to the law society.

    Thankfully things are starting to move along now! We got in touch with our solicitor and sorted things out! Contracts are finally being drawn up and are going to be sent out asap! Thank you for the replies!
