    This is purely hypothetical.
    Under the seperation of powers judges are separate from the law.
    If a judge finds someone guilty and sentences them to jail, but due to under funding the government lets hem out and a crime is committed as in Athlone.

    Can the state be held liable go failure of duty of care.? Or similar
