Bird Nest removal

Hi. About two weeks ago during stormy weather, some chunks of mortar fell off our roof, from underneath the roof tiles. I have arranged a roofer to do the work next week, but today I noticed a bird coming and going into one of the gaps where the mortar fell from.
The mortar looks quite loose and dangerous and needs to be replaced. I am worried about more chunks falling off on top of a child passing the house. We have a big open driveway and the local kids are always playing there.
I dont know to what stage the birds nest is. The bird going in the gap had a piece of twig in his mouth.
Can a nest be removed if there is a risk of danger to the public?
I am really worried that I will have to leave it until the birds leave the nest.
Please everyone dont get on your high horses about nest removal, I want some genuine advice becasue I am worried about someone getting injured.

In cases like this I think it's best to get in touch with your local NPWS Ranger as soon as possible and ask them.

Would it be possible to block the hole temporarily between now and when you're getting the Roofer in? If you block it now the bird might realise it's not an option to keep building there and find somewhere else. The longer you let the bird keep building the nest the further into bad territory (legally and ethically) you go.

As OpenYourEyes said, block up the hole now. It is early in the year so I doubt much damage will be done. They will nest elsewhere. Around now most birds are just preparing nests and many will not even be used.

I rang NPWS, there was no one there to ask, guy on reception didnt know anything.
If I rent a ladder tomorrow I might just about reach one of the gaps, but the other is nearly at the highest point of the gable end, there is no way I would climb that high up a ladder.
So is it ok to stop the birds progressing with their nest or remove the nest as long as they have not laid eggs?

Absolutely. Some times we have to use common sense with these issues.
