title deeds

    I want to purchase a property but have some questions about the deeds. It is an old (1800s) property which has been passed on several times in the family. The deed found in the registry of deeds has no street number, name or map reference. Will this be a problem to register? My lawyer asked the vendors to register but they are refusing. Can I still purchase without this registration in place or will it cause me problems in the future?

    You have a lawyer, you've conspicuously omitted to say what he/she is advising you to do.

    I suspect that this is a case where the lawyer is telling you to walk away but you are so determined to buy the property that you're desperately looking for someone, anyone, to tell you that it's ok to go ahead and buy so you register on boards and seek advice from a bunch of people who know virtually nothing about the situation other than what it took you a few seconds to type.

    I'd do what your lawyer is advising you to do or not do.

    The core principle is validity of title.

    In simplistic terms if the vendor lacks title to sell you will PROBABLY end up with a bad title and all that follows.

    On the bare facts a solicitor would be grossly negligent to allow you to buy.

    I don't know if such a thing still exists but you might ask your solicitor about defective title indemnity insurance.

    IMHO if you cannot get valid title walk away.
