[Very Important] Please help. Legal issue with HSE

    Hi guys, I have a very serious issue and problem.
    I will tell the story here so all of you can understand it.

    So about 8 months ago I went to a Dentist and asked them to check my teeth and to write a letter to a Dental Clinic with the problems I have.
    Then the Dental Clinic sent a letter to HSE, hospital in Cork that I require jaw surgery.

    After a week I went back to the Dental Clinic and I was told that I am on the list for the surgery. So I was very happy that I am on the list for a jaw surgery and It will be covered by medical card.

    So I was happy and waiting, after 3 months I went back to the Dental Clinic because I wanted to see what numer on the list I am for the surgery, I was told that she cant check that for me but I am on the list so i should wait for another 18 months.

    I waited for another 3 months and went back to the Dental Clinic and asked if she can check for me what numer I am on the list, again she told me she cant check that for me as the computers were off. At this stage I was worried about the surgery so I asked the woman at the reception for the phone numer to Cork Hospital, when I called the Hospital in Cork i found out that I am not on the list at all.

    This news was shocking to me as for the 6 months the Dental Clinic was telling me that I am on the list and I just need to wait.


    The problem is that 6 months ago I was working in Penneys on a permament contract and I had enough money to do the surgery privately but because I was told that I am on the list i decided to spend the money and go to College, so I did went to college in Dublin.

    Now I have no money at all and I am unemployed as I had to leave the job in Penneys because i moved from Kerry to Dublin.

    The jaw surgery will cost me around 6,000 euro and I cant afford it.


    If the Dental Clinic told me before that I am not on the list i would spend the money on surgery and not go to College. The surgery is important for me, the problem with my jaw ruins a big part of my life and now I cant afford the surgery.


    My question is if I can do anything to get the Dental Clinic pay for my surgery ? It's their fault that I didint do the surgery.
    I spoke today with the boss of the Dental Clinic and she admitted that there was a communication problem as they didint tell me that I wasnt on the list and that the woman at the reception was providing me with wrong informations, and all she can do for me is appologyse and fix their policy in clinic.


    Appology isnt good enough for me. Because of their mistake I cant get the surgery on medical card and this seriously affects my life.




    I hope everyone can understand my problem.
    Please help me as my life is in bits after the news.

    I think there has to be something I can do about it.

    [Very Very Important] Serious and specific legal issues should be addressed to a solicitor. Cutting corners will result in the legal equivalent of negligent medical care.

    "Cutting corners will result in the legal equivalent of negligent medical care. " What do you mean by that ? sorry but English isnt my first language.


    Also I did try to find a solicitor but non of them knew what to do.
    I am in Kerry now, I will be back in Dublin next week so I will try to find someone there.

    One of the colicitors said I could sue the state and get recompensation. He said i could propobly get few hundred euro about 300 euro.

    But 300 euro is almost nothing comparing to the cost of surgery that is about 5000 euro.
