NO SHOW TO FAMILY COURT?

    I am due in family court tomorrow (as the respondent,not petitioner) but my ex has just informed me she is not attending. Can the judge rule in her absence even though she made the court application?

    you should still attend .
    it will look better for you.
    if she ever tries to bring you back to court for something else.
    also she might be pulling a fast one , by telling you she is not turning up .
    then you would be in trouble .
    i would say nothing to her and attend .

    In the case of an access hearing where the applicant is the man and the respondent is the woman is it likely that if the woman fails to appear having been served with a summons in a proper fashion that the Judge will issue a bench warrant? Or what else is the Judge likely to do in this case? Family Law is all so secretive and arbitrary...

    Also, further down the line, if the woman does not comply with the court ordered access arrangement, what will the Judge be likely to do?

    If you have been summoned to attend then I would strongly advise that either you attend or get legal representation who will attend on your behalf with the explanation that your wife had indicated to you that she was not going ahead.
    Although I would attend myself, keep a record of the proceedings and have it ready for future action.
    Of course as one poster has posted this might be a trick by your wife. She attends, you don't. It reflects bad on you. The Judge may end up issuing a warrant for your arrest depending on what story she comes up with.

    I encountered a case in the family Court a few years ago. The respondent failed to appear and the case was held in their absence. The Judge made his decision on the evidence of the person who was present. Don't know if that goes in any case but it happened in the case of a friend who I accompanied. I had to wait outside the courtroom while the case was heard. So I'd say it would be wise to attend.

    Not as of two weeks ago when the "in camera" rule was lifted
