NCT & tax question

    Just wanted to clarify something.
    A friend has a car which is off the road and out of tax.
    It's not been declared off the road.

    Now I've been asked to sell it for them. So want to throw it through the NCT.

    I don't think the no tax needed on day of NCT will suffice so will they have to sell it to me and can I just declare it off the road till it's ready to sell with NCT done?

    I don't want to have to tax it in case it needs a load of work done. In that case I'll just sell for scrap

    Any advice?

    If it's declared off the road and has no NCT it'll need to be brought on a trailer to the NCT

    Aside from that I'm not really sure what you want advice on? You seem to have a plan...

    you can drive a car with no NCT to the test or to any repairs required on a failure. It's an offence to use it with no tax

    Well I know before the need to declare of the road you could legally drive to the NCT with no tax.
    Does this still apply, and if so will the car need to be declared of the road first?

    If you are insured and have test booked this is the only time the vehicle can be brought/driven on the road.

    It is okay to bring to a test but that is exactly what you have to be doing if caught.

    Just carry the booking ref. no or a copy and no problem at all.

    No you can't, not since last year.


    You can drive the car to the NCTS centre and home if it fails unless it is dangerous where they will hold the car untill it's collected on a flat bed truck.

    All the rules/exemptions are clearly put on motortax.ie

    The car can be out of tax and have no NCT once it is been brought to the test at that time.
    Keep ref. no in car or copy of test.

    A15. A vehicle may be used during the period of a non-use declaration in two cases:
    • to bring it to and from a test centre for the test; or
    • to bring it for repair after a re-test, or back to where you are keeping it while it is off the road after the repairs. This option may only be used where an appointment has already been made for a re-test.
    The same rules apply to roadworthiness testing for commercial vehicles.

    If you are bringing the vehicle to a test centre or to or from repairs after a test failure, it would be advisable to carry a copy of the appointment for the test or re-test with you.

    They can sell the car whenever they wan't they wont be hit with having to back tax as bringing to test centre is allowed.

    If they plan on selling just get NCT if feasible and sell on you won't have to transfer into yours.

    if my car fails nct and my current cert still has a few weeks left before it expires is it taken off me?

    If they do this they will be liable for the back tax owing I assume.

    No only if your friend who owns it now wants to tax it.

    A loophole still exists as he can sell and new owner only pays tax from 1st day they own it so example I buy today 21st I will have to pay tax from 1st of this month.

    If he wants to keep the car then what you do is sell to you or family member then buy it back after a month or so.
