walking out of job

    Hi Guys,

    didn't want to post as my usual moniker as most of yous might know what job im in and i dont want that revealed. hoping to get a bit of advice and i know this place is great for that. :)

    anyway here goes...

    I've been mistreated by management in my job and ive checked and dont really have a leg to stand on to fight them back so i decided to leave and now have another job lined up. I owe them about 2 weeks holidays which if i give notice will just come out of my wage. Now after the way they treated me i just want to walk out if i do is there anything legally they can do to me?
    I've no intention of ever working here again so don't mind burning bridges and will be ok for reference etc in new job. Just wanted to check if anyone has done anything similar and did anything ever come of it?

    There was a thread on pretty much the exact same topic being discussed yesterday. Have a look on page 2 or 3 and you'll see it.

    My advice:

    Don't burn bridges. You never know when you will meet or need these people again. Be mature and try to leave on good terms.

    Give them the minimum notice requirement two weeks or month what every it is and just say you have been offered a new job.

    Most places only expect a employee thats leaving to go through the motions and their focus goes towards your replacement or how they will spread the load.

    ^^ what they said. Also, if you give two weeks notice they may decide to call it quits by letting you go immediately, in which case you can take up the new job (which it appears you are able to do, since you talk about just a walking).

    but say i do walk and dont give the minimum term can they do anything legally to chase down the holiday days i owe?

    I've only ever taken holidays that I had accrued, otherwise they were unpaid days off.

    Maybe this is a stupid question, but how do you owe them 2 weeks holidays?

    If you've got a final pay that they can take the wages from, that's probably what they will do. Doubt they'll bother chasing otherwise.

    NB I can understand fully how you can have taken leave ahead of your entitlement. Happens quite easily in some jobs.

    sf: i used all my leave entitlement for the year at the beginning of there calendar year.

    They "can" take a civil action against you to recoup the money.
    And scenarios like these are fairly open and shut so I would expect them to win.

    When this happens you can expect to have costs awarded against you.

    Now whether or not they are the type of company to go to this trouble for two weeks pay is another matter ,but I know that most companies I have worked for would.

    On a side matter Ireland is a small place ,you never know when you could run into somebody from this company again and your name will be muck.
