In what circumstances do the Gardai seize a vehicle for having no road-tax?
I heard of someone here in Limerick recently having their car seized at a checkpoint for having no tax, and the Garda Siochana Facebook page above mentions a car being seized at a checkpoint? Is this a routine occurrence?

I know somebody that was stopped and given a warning. They didn't tax it and got stopped a few weeks later and it was seized.

Suppose it depends on who you meet :)

Anything that's more than 3 months out of tax can be seized on the spot iirc.

Was it not changed to two months?

    Yes. Section 41 of the Road Traffic Act applies. Copied from Garda website;

If my car is not insured, taxed or I don’t have a driving licence or I am driving a vehicle that I’m not licensed to drive, what is the position if I am stopped by a member of An Garda Síochána?
Section 41 of the Road Traffic Act 1994 as amended by Section 19 Road Traffic Act 2006 applies. A member of An Garda Síochána may seize a vehicle being used in a public place where –

A member of An Garda Síochána is of the opinion that the vehicle is being used in contravention of Section 56 Road Traffic Act 1961 i.e. The person driving the vehicle is not insured to drive the concerned vehicle.
The person driving the vehicle refuses or fails to produce there and then a driving licence then having effect and licensing him/her to drive the vehicle, when production of such a licence is demanded of him/her by a member of An Garda Síochána under Section 40(1) of the Road Traffic Act 1961 and the member is of the opinion that the person is by reason of his/her age ineligible to hold a driving licence, licensing him/her to drive the vehicle.
There is no road tax in force for a period of 2 months or greater.

I thought a traffic garda here said anything over one month out of tax could be seized.

Thats for non display. General penalty applies for no tax which is a summons to court.

Tax must be out two months for seizure. For NCT, CVRT/CRW and insurance, vehicle can be seized immediately if these are not in force.

Of course The Road Traffic Act is always going to be potent and robust in nature. It's the thrust of these powers that sends out a clear message to other motorists that strict adherence to these provisions are necessary with little or no discretion applied by An Garda Siochana. Which ultimately ensures that the coffers for the exchequer are rolling in to prop up Irish Water and who ever else needs it( Heaven forbid it would be used to address the secondary road network), the cash cow that is the NCT is kept in the black and the highly contentious VRT is illegally collected by Revenue contrary to European Law.
So as one can clearly see the noose is continually tightened around the motorist in Ireland. Be under no illusions that there is political policing in this regard in so far as exercising the the full width and breath of this Act to bring in revenue.

    where to start...

one would hope so from a statutory document!

Unfortunity there is far to much discretion shown by AGS, ultimatly leading to where we are now where most people realise there is very little chance of being caught and a very good chance of getting let off even if you are

yeah, lets just not pay to maintain our water infrastructure, hooray!
the cash cow that is the NCT is kept in the black
heaven forbid we get cars checked and maintained and take obvious faulty deathtraps off the roads

nothing illegal about it in the slightest

if it's about revenue, why no ANPR, why no red light cameras, why no bus lanes cameras or tolls the whole length of the m50 etc etc etc

OK so motor tax in Ireland is pretty poorly implemented over all but it is what it is and not bothering to tax your car is no excuse.

    Where to start.....
You are factually incorrect on a number of your points.....Unfortunately I don't have the time to correct your inaccuracies at this stage but will do so later. One point that I just see at a glance is your assertion the ANPR is not in operation. Wrong. It is. Resources would not permit a line of cameras along the M50. That's a ridiculous statement!
Go back and revise your positions and eradicate this notion that there are no connections between policing and revenue exercises!

A footnote...Your condoning the use of taxpayers money to prop up what was a quango!
Good luck! On that basis alone it doesn't warrant a further reply here! Incredible!!

Not entirely sure why this was brought back from 4 years ago when a fresh thread could have been started.
I'm laying it to rest now
