Dealing with BCW

    Hi guys.

About 5 months ago I got scammed for about 250 euro on paypal as I sold virtual goods and got charged back. Seeing as I got scammed I wasn't going to fork this money out. Anyway, about 5 months pass and by now my paypal account is shut down, I get a text today from BCW group urgently asking me to ring them. I had a look around and people said to ignore them.

I'm also 17 and as far as I know debt collectors have no legal rights in Ireland unless they bring you to court?

Can anyone give me some advice on how to deal with this.

They'll have fun as you're 17 - google "enforceability of contracts with minors".

Thanks, came as a shock, forgot all about it. Probably cost more for court than what I owe.

If they continue to harass you you may have recourse to the NFOAPA

etc.11.—(1) A person who makes any demand for payment of a debt shall be guilty of an offence if—(a) the demands by reason of their frequency are calculated to subject the debtor or a member of the family of the debtor to alarm, distress or humiliation, or(b) the person falsely represents that criminal proceedings lie for non-payment of the debt, or(c) the person falsely represents that he or she is authorised in some official capacity to enforce payment, or(d) the person utters a document falsely represented to have an official character.(2) A person guilty of an offence under this section shall be liable on summary conviction to a fine not exceeding £1,500.
Obviously the section of the act should not be taken without reference to case law on the matter that may significantly strengthen the section
